Questionnaire 'tapping SBY': Democrats take the risk?

After Susilo Bambang Yudhoyono called himself become a victim tapping on Wednesday (01/02), the Democratic Party immediately mobilize the right of inquiry to investigate the wiretapping allegations made against the party chairman.

But according to some observers, the Democratic Party steps impractical and too politicized.

"I think this is actually just a form of bargaining just to be chairperson, Pak SBY, not dragged," said Coordinator of Concerned Citizens Forum of Indonesian Parliament, Sebastian Salang.

"But if this is serious, say approved, then this is of course injured

Pak SBY her. Because it's definitely in the right of inquiry will be opened everything. If it was true that there was a telephone conversation that and there is a record, for sure the whole thing would be revealed at the hearing questionnaire. The question then is whether Democrats and Pak SBY ready with all of it? "Added Sebastian.

"From the side it seems to me, is not practical Democrats pushing it."

For the expert in constitutional law Bivitri Susanti, the right of inquiry should be conducted "in the context of the policy of extraordinary. If the president summoned the interpellation right or right of inquiry had been very political."

'It's unlikely escapes'

The right of inquiry shall be proposed by at least 25 members and more than one faction, accompanied by a document containing at least the implementation of policies that legislation will be investigated and the reason for the investigation.

"In kuantiatas not easy in fact for Democrats to push the right of inquiry is to be digolkan in Parliament because the majority of angora parliament it was part of a coalition government. While we know the government does not want this to be protracted into a political issue that can thrive everywhere, "said Sebastian.

Democrats themselves are still trying to gather votes to be submitted to Parliament.

"If 25 people I think there is no problem because it can be from the faction of the Democratic Party itself," said Democratic Party politician, Roy Soeryo.

"One faction we expect is the fraction that may not affiliated directly with governments yes because right now most of the factions has become a supporter of the government. But still we see no Gerindra faction, there is also the PKS faction," added the former Youth and Sports Minister's

Party government supporters PDI-P, also believes that it is unlikely the right of inquiry may qualify in the House because of lack of support and evidence of wiretapping.

"There is a quorum and the quorum quorum party. If the party's 10, only three (Democrat, Gerindra, which carries PKS), seven did not want to continue to do?" said PDI-P politician, Eva Sundari.

"From the PDI-P reminds a lot more important agenda in the House, do not make a questionnaire that has no basis. Because the word 'tap' from Pak SBY himself," added Eva.

Sebastian also criticized the benefits of the right of inquiry for the current political conditions.

"Should the House of Representatives, including Democrats, have a responsibility to curb this situation so that the political atmosphere ahead of the elections do not heat because it will interfere with the implementation of the election simultaneously in 101 regions," said Sebastian.

Objective right of inquiry

Bivitri indicating that the questionnaire was used parliament to topple the president.

"In the past, when we speak of parliamentary context, can be used as a way to bring down the president. Now to ask the president with respect to laws or policies that are not beneficial to the people," said Bivitri.

"In our current system, the president can not be dropped because of its policies. Since the amendment of Law 99/2002, our presidential system stronger so that the president can be passed only in the Constitutional Court if he violated the law. But since kabijakannya, he could not dropped in the middle Street."

Cases of public policy that have been asked the right of inquiry include bersubsisi fuel price hike in 2008 and the case of Bank Century in 2009.

In 2011 was proposed to an inquiry on tax mafia case but eventually failed after being rejected by a majority of House members.
